Copyright Complaint & Takedown Policy

Explore Butte County, a California mutual benefit corporation (“EBC”), respects copyright and expects people who submit content to do the same. This policy explains how to report material on Butte365 that you believe infringes your copyright and how a submitter may respond.

The warranties and licenses in the Event Submission Terms do not replace this complaint process.

Submit a copyright complaint

Send a written complaint containing:

  1. your name and contact information;
  2. identification of the copyrighted work you believe was infringed, or a representative list when the complaint covers multiple works;
  3. identification and location of the material you want EBC to review, preferably including the Butte365 page URL and a description or screenshot;
  4. an explanation of why you believe the use is not authorized by the copyright owner, its agent, or applicable law;
  5. a statement that the information in the complaint is accurate and that you are the copyright owner or are authorized to act for the owner; and
  6. your physical or electronic signature.

Email is the preferred intake method. Do not include sensitive personal information that is unnecessary to evaluate the complaint.

What EBC may do

EBC may ask for clarification, locate and preserve relevant submission evidence, disable or remove material while reviewing a complaint, notify the submitter, share the complaint or relevant portions with the submitter, and take other reasonable action. EBC may decline a complaint that does not identify the work, material, requester, or claimed authority well enough for a responsible review.

Removal is not a final determination of ownership or infringement. EBC may keep limited records needed to document the complaint, action, response, security, or a dispute.

Submitter response

If EBC tells you that material you submitted was disabled or removed, you may send a written response containing:

  1. your name and contact information;
  2. identification of the removed material and its former location;
  3. an explanation of why you believe the material was removed by mistake or why you are authorized to use it;
  4. supporting permission, license, ownership, or other relevant information;
  5. a statement that your response is accurate; and
  6. your physical or electronic signature.

EBC may share the response with the complainant. After considering the available information, EBC may keep the material disabled, restore it, request more information, or decline future use. This ordinary process does not promise a particular review or restoration period.

Repeat credible infringement

EBC may restrict submissions, remove content, suspend access, or decline future content from a person or organization associated with repeated credible copyright complaints or repeated violations of the Event Submission Terms. EBC may consider the number, reliability, resolution, and circumstances of the reports rather than treating every unresolved allegation as a final finding.

Misrepresentations

Do not knowingly make a false copyright complaint or response. A materially false report can harm content owners, submitters, and EBC and may result in restriction of access or other appropriate action.

DMCA status

This launch policy provides an ordinary copyright complaint, removal, and response process. EBC does not represent through this policy that it has registered the contact above as a Digital Millennium Copyright Act designated agent or that it qualifies for or relies on 17 U.S.C. § 512 safe-harbor protection. If EBC later adopts a registered-agent process, it will publish and archive an updated policy and matching contact information.
